تقادم الشهادة وأثره في إسقاط الحدود: دراسة فقهية موازنة بالقانون

الملخص

يدرس هذا البحث مسألة متعلقة بالشهادة وهي، تقادم الشهادة وأثره في إسقاط الحدود، حيث يبين معنى التقادم، أنه: مضي زمان يحدده الحاكم على عدم أداء البينة فيما لا يحتاج إلى دعوى. وكذلك يبين آراء الفقهاء في سقوط الحد عن المشهود عليه، ويصل إلى أن تقادم الشهادة لغير عذر يسقط الحد عن المشهود عليه، لأن مجيء الشاهد للإخبار عما شاهد بعد زمان يورث شبهة في شهادته، تستوجب الرد، وعندها يسقط الحد، لأن الحدود تسقط مع الشبهة. أما ما يتعلق بمدة التقادم وتقدير الأعذار، فإنها تترك للسلطة التقديرية للحاكم، لعدم ورود نص في ذلك، فيكون?التقدير- خاضعاً بحسب الظروف والأحوال، والأزمان.

Abstract

This study is concerned with late testimony and its influence in abating the penalty. The delayed means that long time has been passed without presenting the evidence which is not require for the charge any more, or the views of judges in preventing the penalty of the charged persona, unreasonal late testimony doesnot effect the penalty is because the late testimony is doubtful and the penalty is abated by suspicion. The late testimony durations is determined by the authority, by the situation, circumstances and time.
