الحقوق المالية للمؤلف: دراسة فقهية مقارنة

الملخص

أظهرت المعاملات المالية في الوقت الحاضر جانباً جديداً في حقوق التأليف لم يكن مشهوراً من قبل وهو الاعتياض عن حق التأليف بالمال. وتباينت آراء الفقهاء المعاصرين في اعتبار الحق المالي للمؤلف، وتوصلت الدراسة إلى إثبات مالية هذا الحق مؤيدةً ما ذهبت إليه بالأدلة التي تنهض بترجيح هذا القول ومراعيةً لمقاصد الشرع فيه.

Abstract

Financial - issues, have highlighted a new aspect in copyrights that was not known before, this new aspect involves financial compensation for writing (copyright). This has created a controversy among contemporary Islamic scholars. The researchers believe that the right of writing (copyright) could be compensated with money.
