حق الأجانب في تملك العقارات ملكية تامة في دولة قطر، الاعتراف به والقيود القانونية التي ترد عليه بعد اكتسابه

الملخص:

تعترف دولة قطر للأجانب بتملك العقارات فيها، وجاء هذا الاعتراف وليد المشاركة في الحياة الدولية، وتطور الفكر الإنساني الذي لم يعد يستخف بالأجانب على اعتبار أنهم من أبناء المعمورة، والاستخفاف بهم من شأنه أن يشكل اعتداء على البشرية جمعا.

ولان تنظيم ملكية الأجانب للعقارات في دولة قطر متروك كما هو الحال في جميع دول العالم لحرية الدولة مراعية في ذلك الاتفاقيات والأعراف الدولية، فقد قام المشرع القطري بتنظيم ذلك الموضوع في عدة قوانين. وبما أن هذا الموضوع لم يسبق بحثه في القانون القطري، فقد رأيت ضرورة بحثه في مطلبين، حيث خصصت المطلب الأول لدراسة مدى حق الأجانب في تملك العقارات ملكية تامة في دولة قطر، أما المطلب الثاني فقد عالج القيود القانونية التي ترد على ملكية الأجانب للعقارات في ذات الدولة. وختمت البحث بخاتمة بينّت فيها أهم ما توصلت إليه من نتائج وتوصيات.

Foreigners' rights of real estate ownership in the State of Qatar/State Recognition and Restrictions on Real state Ownership

Abstract  :

Recently the State of Qatar has recognized the foreigner's right of real state ownership. The Qatari Government’s decision to to permit foreign ownership was a result in order to encourage international co-operation and to acknowledge foreigners rights and dignity.

Generally speaking, legislation permitting foreign ownership is regulated and organised by countries’ legislators.  Similarly, the Qatari legislator has legalized the ownership of real estate in several national laws. The new laws have never been discussed academically, and therefore I have discussed this important issue in two chapters. In the first chapter, I have discussed the foreigner's right of real state ownership. Moreover, in the second chapter I have discussed the restrictions on real state ownership.

  I have ended the research with a conclusion of my most important findings and   recommendations.
