الملخص
تتناول هذه الدراسة الأحكام الخاصة بدخول وإقامة الأجانب في التشريعات الأردنية وتهدف إلى بحث مفهوم الأجنبي وتحديد مركزه القانوني وبيان مدى حرية الدولة في تنظيم عمليه دخول وإقامة الأجانب في الأردن.
وبينت الدراسة أن عمليات دخول وإقامة الأجانب تتم وفق شروط وضوابط تحددها التشريعات الداخلية وأن هذه الشروط والضوابط تختلف من دوله إلى أخرى نظراً لاختلاف الظروف السياسية والاقتصادية والاجتماعية والأمنية من دولة إلى أخرى، حيث تلعب هذه الظروف دوراً أساسيا في تحديد شروط وضوابط دخول وإقامة الأجانب إلى إقليم الدولة.
وخلصت الدراسة إلى أن الأردن من بين الدول التي توائم دوماً بين ما يتطلبه القانون الدولي العام من حد أدنى من الحقوق للأجانب وبين حرية الدولة في تنظيم حقوق الأجانب بما ينسجم مع بسط سيادتها على إقليمها والمحافظة على حقوق ومصالح مواطنيها، كما خلصت الدراسة إلى أن قرارات الإدارة المتعلقة بدخول وإقامة الأجانب في الأردن تخضع لرقابة محكمة العدل العليا ، مما يكفل للأجانب الحق في اللجوء إلى القضاء، حيث أن  حق التقاضي يدخل ضمن الحد الأدنى من الحقوق التي يعترف للأجانب بها.

 

Abstract
The legal system controlling the entrance and residence of foreigners in Jordan

This study examines the legal system of entrance and residence of foreigners in Jordan. It aims to define the concept of foreigners and their legal status as well as the authority of the state to determine such status.
The study shows that the entrance and residence of  foreigners is carried out in accordance with common terms and conditions. Such terms and conditions vary from one state to another depending on many factors, such as political, economical, social and security conditions.
The study concludes, that Jordan is one of the states which harmonize between what the International Law imposes of right to foreigners and the liberty of the state to organize such rights, so that they conform with its Sovereignty and Protection of its citizen’s rights and interests. It also concludes that the decisions of the administration concerning the matter are subject to the control of the Supreme Court of the Justice.
This ensures that foreigners in Jordan have the right to resort to the Law, since the right is one of the acknowledged minimum rights of foreigners.
