مدى دستورية المادة الثالثة من قانون الضريبة العامة على، المبيعات الأردني رقم 6 لسنة 1994 وتعديلاته

الملخص

حرصت التشريعات الدستورية على اختلافها، ولحماية الأفراد إزاء السلطة التنفيذية في مجال الأعباء الضريبية؛ على حصر سلطة التكليف الضريبي بالسلطة التشريعية بصفتها ممثلاً للإرادة الشعبية، واستقر تبعاً لذلك، ولترسيخ هذه الحماية العديد من المبادئ الدستورية في مجال العبء الضريبي؛ ومن أهمها مبدأ قانونية الضريبة، القاضي بعدم جواز إصدار تشريعات تكليفيه للأفراد من خلال السلطة التنفيذية.

ورغم رسوخ هذه المبادئ، إلا أن المشرع الأردني خالفها من خلال منح السلطة التنفيذية - في المادة الثالثة من قانون الضريبة العامة على المبيعات- العديد من الصلاحيات التي تمكّنها من تكليف الأفراد بأعباء ضريبية من خلال تشريعات صادرة عنها، حتى وصل الأمر بها إلى فرض ضرائب وجعّل هذه الضرائب المفروضة من قبلها بمثابة وعاء ضريبي تحمّل المكلفين بناء عليها ضرائب أخرى، لنمسي أمام واقع ضريبي غريب مفاده وجود ضريبة على الضريبة.

ولبيان مدى المخالفة الدستورية في هذه المادة، فقد سعى الباحث إلى توضيح المبادئ الدستورية للأعباء الضريبية في المبحث الأول، ثم عمل على توضيح مدى توافق المادة الثالثة من قانون الضريبة العامة على المبيعات مع هذه المبادئ في المبحث الثاني.

The constitutionality of article 3 of the Jordanian sales tax law No (6) for the year 1994

Abstract

It is a common constitutional principle that individuals shall be protected against the abuse of the excutive power in the area of taxation. Thus, the power to impose taxes belongs to the elected legislature as the representative of the people. Hence, the principles that "no taxation without representation"; the principle that taxes are statutory and may not be passed by the excutive authority. Despite these widely recognized principles, the Jordanian legislature has deviated therefrom under section 3 of the general sales Tax Law number 6 of the year 1994. This section vests the excutive authority with a number of powers whereby it can issue regulations (subordinate legislations) imposing tax burdens on the individuals. In exercising these powers, the government has treated some payable taxes as being, on their own, taxable monies. Thus, an anomalous situation has arisen where a tax is levied on the payable tax. This article questions the constitutionality of section 3 of the general sales Tax Law. It is submitted that the general constitutional principles explained in 'section I' lead to the conclusion that section 3 is inconsistent with Jordanian Constitution.
