حجية وسائل تقدير العبء الضريبي وفق قانــون ضريبة الـــدخل الأردني رقم: (28) لسنة 2009

ملخــــص

عمل المشرع الأردني على خلق العديد السُبل أو الوسائل التي تمكن الإدارة الضريبية من تقدير العبء الضريبي على الأفراد بأكثر دقة ممكنه، من خلال توزيع هذا العبء ما بين الإدارة الضريبية والمكلفين على حد سواء.

وجعل لكل طريقة من هذه الطرق حجية في حجم العبء الضريبي لمن تقررت لمصلحته، ومن الوسائل التي وضعها المشرع على المكلفين؛ إلزامهم بتقديم إقرارات ضريبية سنوية وسجلات محاسبية بحجم الدخول المتحققة لهم، تعبر عن الضرائب المتحققة لهم ومن جانب آخر منح المشرع الإدارة الضريبية بعض الوسائل ومنها؛ تدقيق إقرارات وحسابات المكلفين والحق بالكشف على جميع مراكز أنشطتهم ، وجمع المعلومات المتعلقة بدخولهم من مصادرها المختلفة، إضافة الى ما يلجأ إليه القضاء خلال الفصل في المنازعات الضريبية من الاستعانة بالقرائن القضائية أو الاستعانة بالخبرة.

وقد تناولنا في هذه البحث مدى حجية كل وسيلة من هذه الوسائل في مواجهة الطرف الآخر، وقد تم التوصل في هذه الدراسة على أن بعض هذه الوسائل تحتاج الى التدخل في بعض مفاصلها لبيان حجيتها بشكل أوضح للمكلفين أو للإدارة على حد سواء.


The conclusiveness of Techniques Estimating the Burden of Tax Pursuant to Jordanian Tax Act 2009

Abstract

The lawmaker in Jordan has adopted several techniques easing the estimation of tax by the Tax Administration. Such techniques have the effect of distributing the task of estimation equally between the Tax Administration and the taxpayer, and have conclusiveness in estimation.

Among the techniques mentioned above are: a) the annual tax statement prepared by the taxpayer and b) the taxpayer financial records. The lawmaker has granted the Tax Administration the authority to verify these technique, in addition to rights to: visit the places in which the taxpayers practice their activities; gather information regarding to their incomes from its different resources and employ techniques usually used by courts when resolve tax disputes like resort to experts and judicial presumptions.

In this study, the conclusiveness of these techniques is discussed. The study shows that legislative intervention needs to be made so as to clarify the conclusiveness of some of them, on one hand, and to create further limitations on the authority of the Administration in order to prevent any abuse, on the other hand.
