قراءة معمّقة لنصوص مواد قانون المعاملات المدنية الإماراتي الناظمة لأحكام الضمان العشري الخاص بالمقاول والمهندس لما يحدث في البناء من تهدم أو عيوب

الملخص
يعد الضمان الخاص في مقاولات الأبنية ضرورة اقتصادية تسعى معظم الدول على اختلاف اتجاهاتها الاجتماعية والسياسية والاقتصادية لتبنّيه وتحقيقه وتوفيره لمواطنيها خاصةً في ضوء ما تشهده هذه الدول من زيادة هائلة في عدد السكان ومن زيادة في مجال الإستثمارات في قطاع العقارات والإنشاءات وما يرتبط بذلك من ضرورة تشييد الأبنية لغايات السكن أو ممارسة النشاطات التجارية الأمر الذي يتطلب بدوره تدخل المشرع بشكل دائم بغية تحقيق مصالح أفراد المجتمع ومن ثم حماية الأرواح والممتلكات وذلك من خلال تعديل التشريعات ذات الصلة وتطويرها بما يتناسب مع مقتضيات الحداثة والعصرنة وبما يواكب المستجدات والتطورات الداخلية والخارجية.

وقد كان المشرع الإماراتي أحد هؤلاء المشرعين حيث لم يترك مسؤولية مهندسي ومقاولي البناء خاضعة للقواعد العامة التي تحكم عقد المقاولة بل أفرد لها نصوصاً خاصةً؛ وذلك بسبب ما قد يترتب على تهدم المباني من آثار سلبية على صاحب العمل وأضرار جسيمة تصيب الأرواح والممتلكات. لذلك فقد شدّد المشرع الإماراتي في قانون المعاملات المدنية الإتحادي من مسؤولية المقاول والمهندس لحثهم على بذل أقصى درجات العناية واتخاذ كافة الاحتياطات التي تضمن أن تكون المباني سليمة وخالية من العيوب التي تهدد سلامتها ومتانتها. يقدم هذا البحث قراءة معمّقة لنصوص مواد قانون المعاملات المدنية الإماراتي الناظمة لأحكام الضمان العشري للمقاول والمهندس لما يحدث في البناء من تهدم أو عيوب وقد خلص إلى ضرورة إدخال التعديلات على هذه النصوص من أجل تحقيق مبتغى المشرع من وراء تقرير هذا الضمان أصلاً.


“ An In-Depth Reading of the Articles of the UAE Civil Transactions Code that Govern the Tenth Warranty of the Contractor and Engineer against Demolition and Defects of Buildings ”

Abstract
The special warranty in the contraction of buildings is an economic necessity that most countries, regardless of their social, political and economic trends, seek to adopt, achieve and provide for their citizens, especially in light of the dramatic increase in the number of population and increase in investment in the real estate and construction sector that these countries witness, and the related need for construction of buildings for the purpose of residence or the practice of commercial activities, which in turn requires the permanent intervention of the legislator in order to achieve the interests of the members of society, and thence to protect lives and properties through the amendment and development of the related legislations according to the requirements of recentness and modernity and in line with the internal and external latest developments.


The legislator of the UAE was one of these legislators in that it does not leave the liability of engineers and building contractors subject to the general rules governing the building contract, but it provides special provisions, because of the negative implications of the demolition of buildings on the owners as well as on the lives and properties of others. Therefore, the legislator of the UAE in the Federal Civil Transactions Code has emphasized the liability of the engineer and the contractor in order to induce them to make maximum attention and to take all necessary precautions to ensure that buildings are safe and free from defects that threaten their safety and durability. This article provides an in-depth reading of the articles of the UAE Civil Transactions Code that govern the tenth warranty of the contractor and engineer against demolition and defects of buildings. It has reached the conclusion that these articles should be amended in order to achieve the legislator’s goal behind stipulating this warranty.
