الملخص:

بموجب المادة 90 من القانون المدني الأردني رقم 43 لسنة 1976 فإن العقد ينعقد بمجرد إرتباط الإيجاب بالقبول مع مراعاة ما يقرره القانون فوق ذلك من أوضاعٍ معينة لإنعقاد العقد. وقد بينت المادة 91 من القانون ذاته المقصود بالإيجاب والقبول بقولها: إن الإيجاب والقبول هما كل لفظين مستعملين عرفاً لإنشاء العقد، وأن أي لفظ يصدر أولاً فهو إيجاب وأن أي لفظ يصدر لحقاً فهو قبول. والقانون الإنجليزي، من ناحية أخرى، لم يضع تعريفاً محدداً للعقد، ولكن الفقهاء الإنجليز عرفوا العقد على أنه أتفاق يلزم أطرافه ويتم بالإيجاب والقبول. هذا البحث ناقش كيفية التعبير عن الإرادة في التعاقد في القانون الأردني والقانون الإنجليزي وقد خلص إلى أن هناك عدة نقاط يلتقي فيها القانونان معاً وعدة نقاط يختلفان فيها عن بعض.

 

 

Expressing and Communicating the Will in Contracting: A Comparative Study in the Jordanian Civil Code and the English Law.

Abstract  :

By virtue of section 90 of the Jordanian Civil Code No. 43 of 1976, a contract is made as soon as an offer coincides with an acceplance, subject to any additional conditions which the law may prescribe. Section 91 of the Code indicates that offer and accoptnace are two cinventional used in such expressions contracts. The former expression is the offer and the latter is the acceptance. English Law, on the other hand, has not specifically defined a contract, but English jurists have defined a contract as an agreement which arises from an offer and an acceptance and which communicated in contracting under the Jordanian Civil Code as well as in the English Law. It reached the conclusion that here are many similasites and differences between the two laws.
