الملخص

أثار موضوع حبس المدين جدلا واسعا لدى الفقه، ذلك أن الحبس كوسيلة تعني تقييد حرية المدين التي تعد ضمانة أساسية لقدرته على الاستمرار في الوفاء بالتزاماته من جهة، ومن جهة آخرى يثير حبس المدين الكثير من الجدل في أوساط الدائنين الذين يرون أنه بدون التهديد بحبس المدين فلن تكون هناك فرصة حقيقة في بعض الأحيان لاسترداد أموالهم. حاول المشرع الأردني من خلال التعديلات التي أجراها على القانون رقم (9) لسنة 2022 المعدل لقانون قانون التنفيذ الأردني رقم 25 لسنة 2007 إيجاد نوع من التوازن بين مصلحة الدائن المتمثلة في حقه متى ما تقاعس المدين عن الوفاء بالتزاماته، وبين مصلحة المدين المتمثلة في حقوقه كإنسان وحريته الشخصية والأوضاع الاقتصادية والاجتماعية التي يعيشها. غير أن هذه التعديلات لم تكن في كثير من الأحوال مثمرة من الناحية العملية. لقد خلص الباحثان إلى عدة نتائج مهمة منها أن المشرع الأردني أورد حالات جديدة لمنع حبس المدين ومنها المتعلقة بقيمة الدين، فإذا قلت قيمة الدين عن خمسة آلاف دينار فلا يجوز حبس المدين، باستثناء عقود إيجار العقار وعقود العمل. إلا أن المشرع لم يتبن وسائل بديلة فعالة يمكن من خلالها اقتضاء الدين. وعليه فكان من الضروري الاشتباك مع مثل هذه المعضلة القانونية من خلال تبني منهج علمي سليم قائم على وصف الإشكالية من وجهة نظر أكاديمية ثم تحليل موقف المشرع الأردني منها بغية الوقوف على نقاط الضعف إن وجدت لغايات الخلوص إلى نتائج علمية في حال أخذ بها المشرع قد تسهم في الوصول لتنظيم أفضل لإشكالية حبس المدين.

Abstract

This research discusses the issue of the imprisonment of debtors in Jordanian implementation law. The topic has raised widespread controversy in jurisprudence because it restricts the freedom of the debtor, which is, on the one hand, guaranteed their ability to continue to fulfil their obligations. On the other hand, imprisoning the debtor raises a controversy among creditors, who believe that without the threat of imprisoning the debtor, there will be no real opportunity to get their money. Through the amendments made to the Implementation Law No. (9) of 2022, the Jordanian legislator tried to find and create a balance between the interest of the creditor whenever the debtor fails to fulfil his obligations and the interest of the debtor without ignoring the economic and social conditions imposed by the COVID-19 pandemic. Arguably, these amendments were not fruitful in many cases from a practical standpoint. The researchers conclude that the Jordanian legislator adopted new cases to prevent the imprisonment of the debtor, including those related to the value of the debt, which is, if less than 5000 JOD, it is not permissible to imprison the debtor, of course, except for real estate lease and work contracts. However, the legislator did not adopt effective alternative means through which the debt could be assured. The research ended with the adoption of several recommendations that, if adopted, would lead to better regulation of the debtor’s imprisonment provisions.
