الملخص:

يتناول هذا البحث فكرة الإحالة لعدم الاختصاص تلك الفكرة التي أخذ  بها المشرع الأردني مؤخراً بموجب القانون المعدل لقانون أصول المحاكمات المدنية رقم(14) لسنة 2001، وكان الهدف الأساس من وراء الأخذ بها هو تبسيط إجراءات التقاضي. ولما كان الأخذ بهذه الفكرة يثير العديد من المشكلات العملية فقد جاء هذا البحث لتحديد ماهية  الإحالة لعدم الاختصاص وتمييزها عن غيرها من صور الإحالة وبيان نطاقها وتوضيح آثارها  ، وفي الخاتمة تم استعراض أهم النتائج والتوصيات

Abstract  :

This article deals with the notion of “ Transfer Due to jurisdictional reasons” of law suits between courts, which approved by the Jordanian legislator lately in the civil procedures act No(14) of the year 2001.

The aim of adopting such a notion is to simplify judicial  procedures This article deals with the definition of the notion of transfer due to jurisdictional reasons and its scope as well as the effect of transfer due to  jurisdictional reasons .
