الملخص

يظهر هذا البحث أثر علل الأحكام المستنبطة في تحديد نطاق الألفاظ العامّة، وبيان مفرداتها، وتعيين مشمولاتها وجزئياتها، ويبين الباحث أن الوقوف على علل الأحكام المعقولة والمقصودة، أمر ضروري لكل من رامَ فهم النصوص الشرعيّة العامة، ذلكَ أن فصلَ الحكم، عن معناه المقصود، وحكمته المرجوة، وغايته المتوخاه، قد يؤدي إلى تعميم الأحكام الشرعيّة على وقائع وجزئيات غير مقصودة للشارع، ولا مشمولة بإرادته الأولى ابتداءً.

ويخلص الباحث إلى أن تخصيصَ العام بعلّةِ حكمه المستنبطة، منهجٌ أصولي، له ضوابطه وشروطه، وأنه قد لاقى الرعاية والاهتمام من قبلِ جمهور الفقهاء، فقد وظّفوه وأعملوه في العديد من النصوص الشرعيّة بغية الكشف

عن الأفراد الذين توجهت إليهم إرادة الشارع بالتناول.

This paper addresses the cause of induced. I judgment in the Islamic Shari’ah in identifying the scope of general concepts and its vocabularies with its coverage and partiality. It explained that recognition of the concepts of credible and international judgments is of high necessity to any one who desires understanding the general concepts of Shari’ah separating the judgment from its intention, and end leads toovergeneraliting the judgments an situations or events never intended by the legislator (law maker).

The paper concludes that narrowing a general conexpts by an induced causes is a methodological approach with its own conditions and controls. It was applauded by the majority of Fugha’ (Scholars) who followed this approach to unveil the people intended by the judgment or meant by the legislator.
