آفاق الحماية القانونية للمؤجر والمستأجر في ضوء قانون المالكين والمستأجرين الأردني رقم 11 لسنة 1994 وتعديلاته: رؤية مستقبلية

ملخص
إنَّ لعقد الإيجار مكانة مهمة في المجتمع على الصعيدين الاجتماعي والاقتصادي، فهو العقد الذي يتيح للملاك استثمار أملاكهم واستغلالها، ويتيح للمستأجرين الانتفاع بما لا يملكون. وقد حظي تنظيم هذا العقد باهتمام بالغ من قبل المشرع الأردني الذي سنّ عدة قوانين وأدخل عليها عدة تعديلات بهدف تحقيق التوازن بين مصلحتي المؤجر والمستأجر. ولكنّ المشرع الأردني وفي ضوء التعديلات الأخيرة على قانون المالكين والمستأجرين بموجب القانون رقم 30 لسنة 2000 قد بالغ في حماية المؤجر. ناقش هذا البحث آفاق الحماية القانونية للمؤجر والمستأجر وقد خلص إلى أن قانون المالكين والمستأجرين بوضعه الحالي (أي بعد التعديلات الأخيرة) لا يحقق التوازن المنشود بين مصلحتي المؤجر والمستأجر، ولا يحقق الأمن الاجتماعي في الدولة.

Prospects of the Legal Protection of a Landlord and a Tenant in the Light of the Landlord and Tenant Act No.11 of 1994 and its Amendments: A Future Vision

Abstract
A lease contract has an important status in the society at the social and economic levels; it is the contract that allows landlords to exploit their properties and allows tenants to get benefit of the properties which they do not own. The regulation of the lease contract received high attention from the Jordanian legislator, which has enacted many laws and has introduced many amendments to these laws, with the aim of achieving a balance between the interest of a landlord and that of a tenant. In the light of the recent amendments to the Landlord and Tenant Act, however, the legislator has excessively protected landlord. This article discussed the prospects of the legal protection of a landlord and a tenant. It reached the conclusion that the Landlord and Tenant Act, in its present state, achieves neither the sought balance between the interest of a landlord and that of a tenant nor the social security in the State.▲
