The Permanent International Court and its Competence in Prosecuting the Violations of the Occupation Forces in Iraq

Abstract  :

The international community's efforts have led to the establishment of the International Criminal Court (ICC) in 1998. This international court has the competence to deal with the most heinous crimes, particularly war crimes, crimes against humanity and genocide. The establishment of this court aims to fill the gap in the field of international criminal justice through establishing a permanent court instead of ad hoc tribunals. This study aims to examine the possibility of applying the provisions of the ICC statute on the crimes that have been committed in Iraq by the occupation forces. Moreover, this study will also discuss the other options to bring war criminals to criminal justice
