الإطار القانوني للتخطيط والتطوير الحضري في الأردن

ملخص

يعتبر التراث القومي والمصادر الطبيعية والتنوع الحيوي من الكنوز الحقيقية لكل دولةٍ وهذه الكنوز يجب المحافظة عليها وحمايتها، ولكن هذه الحماية لن تكون فعـّالة إلا إذا كانت هناك خطة شاملة للتخطيط والتطوير الحضري مقترنةً بإطار قانوني يحدد وسائل ومعايير هذه الحماية. فالتخطيط والتطوير الحضري يجب ألا يترك للقطاع العام وحده بل يجب أن يكون هناك مشاركة حقيقية وفعالة من جانب القطاع الخاص. تلك المشاركة يمكن أن تغطي شبكات الطرق، البنية التحتية، التخطيط العمراني، إلخ .. بالإضافة إلى ذلك، فإنه يجب أن يكون هناك إطار قانوني مناسب لهذا التخطيط والتطوير. هذا البحث يبيِّن المسائل التي يجب أن تؤخذ بعين الاعتبار من قبل المخططين الحضريين، ويلقي الضوء على الإطار القانوني لهذه المسائل، وهو لا يهدف إلى دراسة كل قانون أو نظام يتعلق بالتخطيط والتطوير الحضري بالتفصيل بل يهدف إلى تقديم عرض لهذه القوانين والأنظمة.

The Legal Framework of Urban Planning and Urban Development in Jordan

Abstract

National heritage, natural resources and biodiversity are considered as the true treasures of every country. These treasures must be maintained and protected. This protection cannot be made effective, unless there is an urban planning and urban development comprehensive plan associated with a legal framework that defines the means and measures of this protection.

Urban planning and urban development should not be left only to the public sector, but there must be a real and an active private sector partnership, which can cover road network, infrastructure, structural planning, etc... Besides, there must be a suitable legal framework for this planning and development scheme.

This article illustrates the issues that should be taken into account by urban planners and urban developers and throws light on the legal framework of these issues. It does not intend to discuss every single law or regulation relevant to urban planning and urban development, but it seeks to give an overview of these laws and regulations.
