النطاق الموضوعي لدعوى مخاصمة القضاة بين   النظرية والتطبيق

الملخص

تعدّ دعوى مخاصمة القضاة ذات أهمية باعتبارها استثناءً من الأصل الذي يقرّ للقضاة حصانة خاصة ، وعدم مسؤوليتهم عن أعمالهم ، حماية لهم من الكيد والتشهير بهم ، والنيل من هيبة القضاء ، ومع ذلك ، وباعتبار أن القضاة من البشر وقد يخطئون أثناء عملهم ، ويلحقون الضرر بأحد أطراف النزاع ، فإنه من العدل والإنصاف ، رفع هذا الضرر الناجم عن عمل القضاة وقراراتهم ، في حالات معينة عن طريق مخاصمتهم .

ولما كانت لهذه الدعوى خصوصيتها فقد وضعت التشريعات قيوداً تحدد فيها نطاقها الموضوعي وشروطها الشكلية بشكل صارم . وبالنسبة للنطاق الموضوعي لدعوى المخاصمة ، وضعت هذه التشريعات حالات محددة يخاصم بسببها القاضي ، منها ما هو عمدي ويستوجب سوء نيّته وتعمده في ارتكاب الفعل ، ومنها ماهو غير عمدي ومع ذلك يمكن ملاحقته بموجبها .

وعرضنا في هذا البحث تلك الحالات ، من خلال بيان مفهومها والتطبيقات القضائية بخصوصها في سورية ولبنان ، باعتبار أن توفر إحداها هو شرط أساسي لإقامة دعوى المخاصمة وقبولها .

 

The substantive scope for the litigation against judges between theory and practice

Abstract

Litigations against judges is very important because it is exceptional  to the rule that grants judges special immunity and exempts them from responsibility of their actions  in order to protect them against maliciousness and defamation, and against the undermining the prestige of  the judiciary.  However, as judges are human beings who may make mistakes that cause damage to one of the litigating parties,  it is just and fair to lift the damage caused by their  decisions, and in specific cases, to litigate against them.

Since this kind of lawsuit has its own specificity, legislations  have strictly laid its substantive scope and formal conditions. As for the substantive scope of this lawsuit, legislations have named specific cases in which the judge can be prosecuted, some of which can be deliberate and resulting from ill-intention, and some are not intended but  prosecutable.

This research paper demonstrates such cases in Syria and Lebanon by clarifying their concepts and the judicial application relating to them,  since the availability  of one of them is a prerequisite for starting  the proceeding of  litigation and accepting it
